HMRC Penalty Charge

I was 7 days late with a Self Assessment Tax Return. The reason it was late was because the PIN that was sent to me through the post didn't work. I had to wait for a replacement once the HMRC website 'locked' me out of the online submission forms.

I received a demand for £100.00 with a note that if the tax liability due on the 31st January was less than £100 the penalty would AUTOMATICALLY be cancelled.

Eventually the penalty was forgotten about until several weeks later I received a another demand for the penalty that I thought had been cancelled.

I lodged a 'late' appeal and several weeks later nothing had been heard back from the State's money raising department.

Last week I got a letter acknowledging my appeal, but yesterday I received a letter from another department warning that they wanted to visit my home to list my goods with a view to selling them on to settle the debt, which was don't forget a summary fine for paperwork submitted a few days later than they wanted it.

I just called the Debt Management Unit in Newcastle upon Tyne. The woman was all apologies and excuses. She told me that the account was on hold and the appeal was under review and that no further enforcement action would be taken while the account was in it's current status.

I found it appalling that they can send a threatening letter (and then say they have no control over it's contents), give me 48 hours in which to respond and yet it take 7 days to arrive. HMRC say that due to the large number of such letters they send out it is not possible to post them all out on the day of posting.

I was also told not to worry because the 'Field Force' SHOULD review the status of the account before they 'knock' on my door. (I have a mental picture of that poster with armed police using a battering ram on a front door with the words 'KNOCK KNOCK' printed underneath. Should not would I hasten to add!

Well let's hope they do, because HMRC 'field force agents' can obtain a Magistrates Warrant to use force when entering a property. What should be a check on the misuse of the vast power of the State would likely be a case of a lay person or Legal Advisor asking for proof of the 'debt' and confirmation of my home address. But alas the Magistrates Court's unlikely refusal to issue said warrant would be my only legal protection from a bunch of over grown shaven headed men, probably wearing body armour, from forcing their way into my home whilst my terrified wife and children tremble in the corner of the room. 'Helpfully' the Debt Management Unit claims not to know anything of the processes the 'Field Force' use to do their bidding.

So readers, it appears that the HMRC likes to send menacing letters and then pretend they have no control over them, they like to blame being over worked for dragging their heels but expect you the taxpayer to submit your tax return by their due date without giving you the benefit of doubt. They like to instruct a 'Field Force' of agents but have no interest in how this force of people actually go about their business.

In my case they like to make you feel that you always on the edge of disaster in a process that they started because of a few pence income tax and a whopping £100 fine for it's late payment.

I suppose it's all geared to getting me to throw in the towel and simply pay the summary fine. I suppose if they do kick the front door down and terrify my children it will be my fault for being 7 days late in submitting a tax return that showed a liability of less than a pound. I am therefore a terrible father.

Company director arrested for attempted murder after rescuing son being beaten by yobs

A case of reasonable force-outnumbered and acting instinctively to stop lethal force being applied to the head of his step son through the feet of drunken out of control thugs. If the police had given the family a truncheon and training this would have played out differently.

Of course he could have run after the group as they walked away and stabbed one of them in revenge but the fact he was arrested BEFORE the police knew about his injured son might be a good sign.

I wish the thugs had been arrested for attempted murder though, because kicking someone in the head is a good way to kill them.

A company director has been arrested on suspicion of attempted murder after confronting a gang of yobs who were attacking his stepson.
Colin Philpott, 58, allegedly stabbed a 16-year-old in the chest during the incident in the front garden of his £500,000 Tudor-style house.
He had awoken late on Friday night to discover stepson Alex Lee being beaten by the group of teenagers.

Mr Lee, 25, had gone outside to stop the gang from vandalising Mr Philpott’s Jaguar car. Mr Lee was said to have then been punched and kicked in the head, suffering a broken nose and concussion for which he needed hospital treatment.
Susanne Philpott, 51, says her husband – who owns an escalator cleaning company – rushed out to defend her son with a letter-opener he had grabbed from a shelf. It was then that the teenager was allegedly stabbed five times. He was taken to hospital and was last night said to be stable.
When police arrived at the five-bedroom house in Crowthorne, Berkshire, Mr Philpott was arrested on suspicion of attempted murder. Five youths, aged 16 and 17, were arrested on suspicion of assault and criminal damage.
Mrs Philpott said: ‘My son and I came out at about 11pm after hearing a bang and we saw two young guys outside our house.
‘They returned 15 minutes later – with three others – and all were visibly drunk. I took a digital camera and told them that if they vandalised anything else I’d take pictures as evidence.
‘One said that he would kill me and burn down my house. I was terrified and when Alex tried to calm him down, the other four got worked up and they all attacked him. Alex ended up on the ground with all five of them on him, kicking him in the head and stomach. I was so frightened for him that I screamed for Colin, who was in bed.
‘He came running out – still barefoot and half asleep – and saw the mess Alex was in so ran back into the house. He grabbed the first thing he saw, which was a letter-opener, and confronted the boys.
'The gang said that they would kill me and burn my down my house.'

‘They attacked Colin and I saw one stumble into the road as Colin screamed for me to call the police. When the police arrived and then arrested Colin, I was gob-smacked.
‘It was heartbreaking to see him handcuffed and carted off like a common criminal. He is a hardworking, honest family man and was only trying to protect us.’
The mother of two, who works as a training consultant, said the quiet neighbourhood had been blighted by teenagers attacking cars and defacing gardens for several months.
She claimed that just days earlier, Mr Philpott’s £30,000 S-Type Jaguar had been smothered with hair gel while it was parked on the driveway.
‘We have had lots of trouble with vandals and they have targeted us twice within a week. The worst thing is that I am now terrified in my own home.
‘The police have installed a panic button but I still don’t feel safe. My husband and I had a holiday planned but now I wouldn’t feel safe leaving my 22-year-old daughter on her own.
‘I just can’t get over how one minute you’re happy and everything is fine and the next your life has been turned upside down by some mindless yobs.’
Terry Brenner, a 55-year-old pipe fitter, described how he was walking past the scene of the stabbing at about 11.30pm. Mr Brenner said: ‘The son was sitting on the doorstep and had facial injuries. The ambulance had already taken away the injured boy and the police had taken away Colin.
‘Susanne was with her son and the policeman came over and said the father could be prosecuted for attempted murder. The poor lady just collapsed.
‘That’s when the policeman realised that someone else had been injured and he called an ambulance for her son.’
One neighbour said that Mr Philpott’s green Jaguar had been discovered the day before the incident covered in a white substance.
Others said some badly-behaved teenagers used the modern housing estate as a cut-through to get to a nearby park.
One said: ‘They act like yobs and are bullies. I am so upset at what has happened to my neighbour. He’s a lovely man.’
Other residents said gangsof youngsters had ripped up flower beds, thrown eggs at them and thrown objects through open windows. Neighbours have reported the anti-social behaviour to the local council and a councillor is said to have asked Thames Valley Police to take action.

Last night the force confirmed that Mr Philpott had been released on bail, pending possible charges.

I got a parking ticket! But it doesn't make me a criminal, even though I need to be punished.

I am not a criminal. The parking arrangements in these parts have been 'de-criminalised'. Phew thats a relief. But hang on, the local Council still demands the sum of £50 from me as the registered keeper of a car that was seen parked in a free parking bay with two of it's tyres straddling a painted mark on the road.

A 'Civil Enforcement Officer' punished me for my non-crime.

You see if the local 'authority' can dictate to you and I within a few inches (or should that be a few more centimetres) where we are allowed to park (free of charge) on the side of the Highway then I am afraid they are getting us used to simply taking their orders without question.

My initial thoughts were that 'but this is England, a place where the rule of law is exercised in a gentle and sensible way, a place where only necessary laws are enforced in a way that only the unreasonable would object.

Anyway it ended with me calling the CEO a 'Taxman in a daft hat'. He just walked off with a confused look on his face, the kind that suggested to me that he didn't know what the word 'daft' actually meant. Oh well I suppose I will have to fight the penalty charge even though I have not broken any law and never entered into any contract with the local 'authority'.

Cards Act 2006 (Provision of Information without Consent) Regulations 2009'.
The other two establish fees and penalties that can be applied to anyone
registered on the ID database.

We need you to write to your MP *NOW* to get them to vote against these key
pieces of secondary legislation.

The 'Provision of Information without Consent' regulation would give powers
to the Identity and Passport Service to pass on information it holds on you
to a host of other agencies WITHOUT YOUR KNOWLEDGE OR CONSENT. This
information would include not only official document numbers, and personal
details like your name, addresses and signature (more than enough to
facilitate massive identity fraud) but also your fingerprints and even - to
the police, intelligence services, taxman and ANYONE ELSE THEY AUTHORISE -
details of every time you had had your ID checked, e.g to register with a
GP, open a bank account or apply for credit, or travel abroad. Your medical
and financial dealings conveniently tagged and indexed for further snooping.

Records of what information has been given to whom and why may be destroyed
after 12 months or less. They would track you for life, but prefer to leave
no trail of their activities.

Contrary to some recent media reports, the ID scheme is still very much
alive. From 2011 onwards you will still be forced to register on the ID
database when you apply for or renew your passport. Some, including young
people and those living in the North West of England, may be duped or
bullied into registering for a card from later this year - and once you are
on the database, there is no way off. The fees, penalties and
data-trafficking established by these regulations would apply to you for
life.

Blocking these three Statutory Instruments would not only stall the Scheme,
it provides an opportunity for ID opponents to show how committed they are
to killing it off completely. It is important that as many MPs of all
parties as possible vote against them on Wenesday 8th July.

The Register reports Police to use Wikipedia

As we all know Wikipedia's content is written by it's readers. Is there anything to stop the CPS or someone in the Police or Ministry of Justice writing what THEY want the Courts to believe about a particular subject or object and presenting the info as an unbiased third party source?

The Crown Prosecution Service is telling police officers to use Wikipedia to prepare for court cases.

Mike Finn, an expert witness on martial arts and weapons, told the Police Review he was involved in a case in the Midlands and asked to prepare a report on a weapon.

According to the Telegraph, Finn said: "The material they gave me had been printed out from Wikipedia.

"The officer in charge told me he was advised by the CPS to use the website to find out about the weapon and he was about to present it in court.

"I looked at the information and some of it had substance and some of it was completely made up."

Finn said he had heard of at least three other cases were police were told by the CPS to get onto Wikipedia. He added: "When an organisation like the CPS tells you to look at Wikipedia, you might believe it is some kind of authority. It is unsettling that potentially unsafe and inaccurate evidence could be presented in court." ®
